Per comunicazioni o richieste, la Societ\u00e0 \u00e8 raggiungibile via posta all\u2019indirizzo della sede legale.<br><br>\n\nTitolare del trattamento e DPO<br>\nLa Societ\u00e0 \u00e8 titolare del trattamento dei Dati dei partecipanti ai casting relativi a programmi televisivi prodotti dalla Societ\u00e0 stessa.\nLa Societ\u00e0 ha nominato un responsabile per la protezione dei dati (\u201cDPO\u201d), raggiungibile all\u2019indirizzo e-mail dpo@endemolshine.it.<br>\nCategorie di Dati trattati e origine degli stessi<br>\nI Dati trattati dalla Societ\u00e0 possono includere:<br>\n1) Dati comuni forniti tramite la compilazione di formulari, questionari, schede casting, interviste e\/o strumenti di comunicazione a distanza (es.: Dati anagrafici, Dati di contatto, Dati relativi a Sue precedenti esperienze lavorative e non, Dati inerenti ai Suoi interessi, ecc.);<br>\n2) Dati comuni consistenti nella Sua immagine e\/o voce fotografati, registrati e\/o ripresi.\nI Dati saranno raccolti presso di Lei e\/o soggetti terzi coinvolti nel processo di casting (es.: agenti, procuratori, consulenti\/collaboratori, genitori\/tutori in caso di minori, ecc.), nonch\u00e9 ove necessario consultando fonti pubbliche e\/o banche dati private accessibili al pubblico (es.: consultazione d\u2019informazioni connesse a profili pubblicati su social media).<br>\nBase giuridica e finalit\u00e0 del trattamento dei Dati e natura del relativo conferimento<br>\nI Dati saranno trattati dalla Societ\u00e0 per i seguenti fini:<br>\n1)\tgestione delle procedure di selezione dei partecipanti al programma televisivo oggetto di casting e valutazione della coerenza del Suo profilo rispetto alle esigenze artistiche e\/o di comunicazione del programma stesso. Quanto ai Dati comuni trattati per questa finalit\u00e0, la base giuridica del trattamento \u00e8 l\u2019art. 6, par. 1, lett. b) GDPR, perch\u00e9 esso serve a eseguire misure precontrattuali adottate su sua richiesta;<br>\n2)\tgestione degli adempimenti legali derivanti dalle norme cui la Societ\u00e0 \u00e8 sottoposta. Quanto a questa finalit\u00e0, la base giuridica del trattamento \u00e8 l\u2019art. 6, par. 1, lett. c) GDPR, perch\u00e9 esso serve per adempiere a obblighi legali a cui la Societ\u00e0 \u00e8 soggetta;<br>\n3)\tadempimento degli obblighi della Societ\u00e0 nei confronti dei propri clienti e partner commerciali. Perci\u00f2, se non strettamente necessario, Le chiediamo di non fornire tali informazioni.<br>\nQualora si verifichi un trattamento di Dati di terzi da Lei comunicati alla Societ\u00e0, Lei si porrebbe come autonomo titolare del trattamento, assumendosi gli obblighi e le responsabilit\u00e0 di legge. Qualora Lei tratti Dati di terzi nel contesto del casting, deve garantire, assumendosene ogni connessa responsabilit\u00e0, che tale particolare ipotesi di trattamento si fonda su un\u2019idonea base giuridica, legittimante il trattamento stesso.<br>\nAmbito di comunicazione e diffusione dei Dati e destinatari e trasferimento dei Dati<br>\nI Dati saranno trattati da personale incaricato del trattamento ai sensi degli artt. 29 e 32 del GDPR e 2-quaterdecies d.lgs. 196\/2003.<br>\nInoltre, per i suddetti fini, i Dati potranno essere comunicati in Italia e all\u2019estero ad altre societ\u00e0 del Gruppo Banijay e a soggetti terzi nominati responsabili del trattamento ai sensi dell\u2019art. 28 GDPR.<br>\nAltres\u00ec, le altre societ\u00e0 del Gruppo Banijay potranno accedere ai Dati per fini amministrativi e\/o contabili, ai sensi dei considerando 47 e 48 e dell\u2019art. 6 GDPR.<br>\nEventualmente, i Dati saranno accessibili a clienti e altri partner commerciali della Societ\u00e0, nonch\u00e9 a enti e\/o soggetti autonomi titolari del trattamento a cui sia obbligatorio comunicare i Dati in forza di norme cogenti.<br>\nTrasferimento dei Dati verso organizzazioni internazionali e\/o Paesi terzi<br>\nQuanto all\u2019eventuale trasferimento dei Dati verso organizzazioni internazionali e\/o Paesi terzi, il trattamento avverr\u00e0 secondo uno dei modi consentiti dalla normativa vigente (es.: adozione di clausole contrattuali tipo approvate dalla Commissione Europea, selezione di soggetti aderenti a programmi internazionali per la libera circolazione dei Dati od operanti in Paesi considerati sicuri dalla Commissione Europea, ecc.). In particolare, richiederemo il suo esplicito consenso qualora sia necessario procedere al trasferimento dei dati verso Paese non soggetto a decisione di adeguatezza da parte della Commissione Europea e che non fornisce garanzie adeguate in materia di protezione dei dati personali.<br>\nSu richiesta, \u00e8 possibile ottenere maggiori informazioni in merito dal DPO e\/o dalla Societ\u00e0 ai contatti suindicati.<br>\nConservazione dei Dati<br>\nI Dati saranno conservati per il tempo necessario a raggiungere le finalit\u00e0 per cui sono stati raccolti, rispettando i principi di limitazione della conservazione e minimizzazione di cui all\u2019art. 5, par. 1, lett. c) ed e) GDPR e fino a un massimo di dieci anni dal completamento del programma cui afferisce il casting.\nTerminato il periodo di conservazione i Dati saranno anonimizzati o distrutti.<br<br>>\n\n\nI diritti di cui al GDPR<br>\nIn relazione ai Dati, Lei potr\u00e0 esercitare i diritti di cui agli artt. 15-22 GDPR, in presenza dei relativi presupposti normativi.<br>\nIn particolare, Lei avr\u00e0 il diritto di chiedere alla Societ\u00e0 l'accesso ai Suoi Dati, la rettifica o la cancellazione degli stessi, la limitazione del trattamento nei casi previsti dall'art. 18 GDPR, nonch\u00e9 di ottenere in un formato strutturato, di uso comune e leggibile da dispositivo automatico i Suoi Dati, nei casi previsti dall'art. 20 GDPR.<br>\nAltres\u00ec, Lei potr\u00e0 formulare una richiesta di opposizione al trattamento dei Suoi Dati ai sensi dell\u2019art. 21 GDPR ove evidenziare le (ii) coloro che abbiano precedenti penali e\/o carichi pendenti e altres\u00ec coloro i quali abbiano cause di impedimento, ossia qualsiasi evento e\/o situazione oggettiva che sia in contrasto con i tempi e le modalit\u00e0 di realizzazione del Programma); (iii) coloro che hanno gi\u00e0 preso parte ad altre edizioni del Programma; (iv) i minori di diciotto anni. <br>\n\u2022\tche non sussiste alcuna delle cause impeditive di cui sopra e di aver autonomamente deciso, in piena libert\u00e0, di prendere parte alla selezione dei partecipanti al Programma proponendosi come concorrente dello stesso e pertanto accettando di sottoporsi ad un Provino ed a tutte le altre procedure necessarie per consentire a ENDEMOL SHINE ITALY di valutare o meno se poter essere scelto tra i concorrenti del Programma. <br>\n\u2022\tTutto quanto sopra premesso e costituendo la premessa parte integrante e sostanziale, il\/la sottoscritto\/a dichiara irrevocabilmente, rimossa ogni eccezione, quanto segue:<br>\n\u2022\tdi aver consegnato alla ENDEMOL SHINE ITALY uno o pi\u00f9 file digitali contenenti materiale audiovisivo e\/o fotografico, filmato, registrato e\/o comunque realizzato in relazione al suddetto Provino, contenente le proprie dichiarazioni e\/o comunicazioni, cos\u00ec come il materiale biografico relativo alla sua vita e fornito dal sottoscritto che il sottoscritto ha personalmente realizzato e di cui detiene tutti i relativi diritti d\u2019autore, Materiale che sar\u00e0 utilizzato per il Programma.<br>\n\u2022\tdi essere in possesso di tutte le necessarie autorizzazioni e liberatorie per lo sfruttamento economico dei diritti d\u2019autore e\/o dei diritti di immagine di soggetti terzi eventualmente raffigurati nel suddetto materiale e di essere titolare esclusivo dei diritti di sfruttamento economico del Materiale stesso.<br>\n\u2022\tdi autorizzare irrevocabilmente ENDEMOL SHINE ITALY e\/o suoi aventi causa a qualsiasi titolo, con diritto ma non obbligo, ad utilizzare liberamente quanto sopra e cio\u00e8 tutto il materiale fotografato, filmato e\/o registrato e comunque realizzato in relazione al suddetto Provino, le proprie dichiarazioni e comunicazioni, ivi incluse il suo nome cos\u00ec come il materiale biografico relativo alla sua vita e fornito dal sottoscritto (d\u2019ora in avanti complessivamente il \u201cMateriale\u201d), senza restrizione alcuna, in tutto il mondo, in perpetuo e comunque per tutta la durata di protezione legale quale sancita in ogni paese del mondo, concedendovi fin d'ora la pi\u00f9 ampia liberatoria, autorizzazione e cessione dei diritti in relazione al Materiale con la pi\u00f9 ampia estensione ed con ogni mezzo, nessuno escluso; in via meramente indicativa: in sede cinematografica, televisiva (Free Television e Pay Television, ambedue via etere, cavo e satellite, con trasmissioni dirette e indirette, inclusa la comunicazione al pubblico via satellite e la ritrasmissione via cavo, anche a mezzo di TV interattiva e TV digitale e ivi incluse Subscription Pay TV e Pay-per-view, Near Video on Demand, Video on Demand, ecc. per un numero illimitato di passaggi), radiofonica e audiovisiva attraverso i videogrammi con ogni sistema distributivo e con ogni supporto meccanico (ad es. videocassette, videodischi, videonastri, nastri videomagnetici, dischi laser, CD, Cdi, CD-Rom, ecc.), multimediale interattiva attraverso i videogrammi (Cdi, CD-Rom, Microdisk, Playstation, Saturn, ogni piattaforma di gioco \u201cRead Only Memory\u201d, Laser Disk, Nastri digitali \u2013 D1, D2, ecc. \u2013 Video CD, Photo CD, ecc.) e relativa commercializzazione attraverso tutti i canali di vendita (On-line, Off-Line, Bundling, ecc.), a mezzo rete informatica, anche via internet, rete telematica, rete telefonica, trasmissione dati via etere, video, ecc., nonch\u00e9 con qualunque altro supporto, inclusi cineromanzi e opuscoli, ed in qualsiasi altra forma e\/o modo e con qualsiasi altro mezzo e processo tecnico gi\u00e0 noto o ancora da scoprire. Parimenti s\u2019intende ricompreso nella predetta autorizzazione il diritto di apportare, al Materiale ripreso in diretta e\/o registrato, elaborazioni, riduzioni, tagli e\/o modifiche di ogni genere, anche mediante eventuali mutamenti di sequenze e\/o inserimenti di altro materiale ecc.; (ii) il diritto di abbinare al Programma iniziative ed interventi di carattere pubblicitario a favore di terzi, in qualsivoglia forma attuabile, effettuando i necessari inserimenti e le conseguenti interruzioni, nei limiti e con le modalit\u00e0 di cui alla normativa vigente (iii) il diritto di utilizzare la mia immagine e\/o la mia voce e\/o il mio nome sia per l'elaborazione, realizzazione e messa in commercio di qualsiasi prodotto legato all'esercizio dei diritti ancillari e dei cosiddetti \u201cmerchandising rights\u201d ricavati dal Programma sia in ogni forma di pubblicit\u00e0 e di lanciamento sul mercato di detti prodotti.<br>\n\u2022\tin merito all\u2019utilizzazione del Materiale da parte di ENDEMOL SHINE ITALY e\/o suoi cessionari o danti\/aventi causa, il sottoscritto dichiara di non avere nulla a pretendere n\u00e9 da ENDEMOL SHINE ITALY n\u00e9 da suoi cessionari o danti\/aventi causa ed in generale da chiunque utilizzi e sfrutti il Materiale e concede la pi\u00f9 ampia liberatoria al riguardo impegnandosi altres\u00ec a manlevare ENDEMOL SHINE ITALY e\/o i suoi danti\/aventi  causa, ad ogni effetto di legge per qualsivoglia pretesa personale e\/i di terzi in relazione al contenuto di tutte le dichiarazioni rese.<br>\n\u2022\tdi rinunciare fin d\u2019ora irrevocabilmente ad ogni azione diretta e\/o indiretta che possa ritardare e\/o ostacolare e\/o impedire la produzione, la distribuzione, la messa in onda, la promozione o comunque lo sfruttamento del Materiale nelle forme sopra specificate. Il sottoscritto dichiara di comprendere ed accettare espressamente che, qualora ponesse in essere azioni e\/o comportamenti che possano causare i ritardi, gli ostacoli e\/o gli impedimenti sopra sinteticamente esposti a titolo esemplificativo, salvo altri, il sottoscritto sar\u00e0 direttamente responsabile nei confronti di ENDEMOL SHINE ITALY per ogni relativo danno sofferto da ENDEMOL SHINE ITALY.<br>\n\u2022\tdi essere stato chiaramente informato da ENDEMOL SHINE ITALY che \u00e8 attualmente in corso la fase selettiva dei possibili partecipanti al Programma e che, pertanto, nessuna pretesa\/ragione di qualsivoglia natura potr\u00e0 essere avanzata in relazione alla propria partecipazione e\/o mancata partecipazione al Programma. Pertanto, il sottoscritto dichiara espressamente di essere consapevole e di accettare senza riserve che la presente partecipazione al Provino non attribuisce al sottoscritto diritto alcuno ad essere selezionato per partecipare al Programma.<br>\n\u2022\tdi impegnarsi a sottoscrivere qualsiasi atto ricognitivo dei diritti ceduti a ENDEMOL SHINE ITALY e che ENDEMOL SHINE ITALY potr\u00e0 liberamente cedere i diritti di cui al presente atto.<br>\n\u2022\tdi impegnarsi a mantenere strettamente riservata e confidenziale ogni informazione relativa al Provino ed in relazione a tutto quanto eventualmente appreso durante gli eventuali e successivi incontri e\/o le eventuali successive riprese in relazione al Programma e al suo contenuto e\/o e comunque relativo alla ENDEMOL SHINE ITALY e\/o ai Suoi danti\/aventi causa e\/o alla produzione di cui in oggetto, essendo vietato trasmettere a terzi tutte le informazioni apprese (d\u2019ora in avanti, complessivamente, le \u201cInformazioni\u201d), con espresso obbligo di proteggere da terzi non autorizzati, amici e familiari compresi, la documentazione e le Informazioni. A titolo meramente esemplificativo, il sottoscritto prende atto ed accetta che allo stesso \u00e8 fatto divieto di pubblicare, far pubblicare, trasmettere o far trasmettere, divulgare o far divulgare, diffondere o anche solo rendere accessibili, sia direttamente che indirettamente al pubblico, sui social network, alla stampa ovvero a qualsivoglia terzo, fotografie, informazioni, documenti, dati, notizie di qualsivoglia natura, sia tecnica, artistica, commerciale ed economica, in breve le \u201cInformazioni\u201d tutte relative al Programma, ad ENDEMOL SHINE ITALY e\/o ai Suoi aventi causa.
